Terms and Conditions The Company. Means UK Appliance Direct, a Trading Name of EWB Cotton Ltd, 54 Church Street, Barrow in Furness, Cumbria, LA14 2HY, Registered in England & Wales 4451158 These Conditions and the Contract shall be subject to and construed in accordance with the Law of England. The Customer. Means the person or company assuming responsibility for the payment of goods. The End User. Means the person or company or appointed agent that will utilize and/or receive the goods. An Order. Means the customer has made a request for goods from the company but this may be subject to change. A Contract. Means an agreement has been reached by both the customer and the company and the customer has confirmed. Acknowledgement. Means written or e-mail confirmation of your order. It is not confirmation of the ability to supply. Acceptance of orders. Although the Company takes great pains to ensure that all information supplied to the customer by way of description and/or illustration is correct and accurate. It remains the responsibility of the customer and/or the end user or their agent to: A: Determine the suitability of the goods for the required application. B: Check the acknowledgement and report any irregularities (ie model, make, colour) immediately C: Check the item being delivered for correct coding to packaging, damages, colour. D: The order becomes a contract only after the company has confirmed its ability to supply the said goods. The Company only accepts an order once a payment is made. The exchange of funds is not deemed an acceptance of contract. It is acceptance of order to supply goods yet to be confirmed by both parties. In the event the customer and/or the end user or their agent accepts goods that subsequently are found to be incorrect there may be a charge to affect the exchange. In this situation the company does not accept responsibility for the delivery of incorrect goods and it is deemed that the contract is complete. The company will in each and every event attempt to satisfy the customers and/or end users request for as long as the company or other customers do not suffer any losses. Description. The Company cannot be held responsible for errors in descriptive, pictorial or written material issued or published by the manufacturers of goods offered for sale. Although the Company takes great pains to ensure that all information supplied to the customer by way of description and/or illustration is correct and accurate. It reserves the right to make changes without prior notice to any such material be it printed or on the company web site or an affiliated web site, of goods offered for sale. Prices. All prices include V.A.T which is charged at the rate prevailing at the time of dispatch. If in the unlikely event a pricing mistake is discovered pertaining to your order, be it prior or post any payment you will be contacted immediately. You will then have the choice of accepting the corrected offer ordering another make and model or have your order cancelled and any money paid refunded. Delivery. Delivery is FREE provided your order is over £250.00. For orders less than £250 a charge of £20 will be made. Please be aware, we are only able to deliver within the UK Mainland. Delivery will be made by 1 man and help on site will be required for range cookers, fridge-freezers, washing machines, washer-dryers and any other item that is outside health and safety guidelines. Due to insurance restrictions deliveries can only be to the ground floor. It is the responsibility of the customer and/or end user to advise of any difficulties that may be encountered at point of delivery, ie: steps, narrow door ways, soft path ways road access. Delivery to other floors is at the discretion of the driver and the full responsibility of the customer and/or end user or appointed agent. Any claims for damages resulting from such a request be they to goods or persons will not be accepted by either the company or its insurers. We reserve the right to fail delivery if we have not been informed that: A: Delivery is to a floor other than the ground floor, B: Access to the property is deemed too difficult and/or dangerous C: The customer and/or end user or their agent is in any way difficult or abusive. In the event of a failed delivery there will be a charge of £25 for a subsequent delivery Damages. All visible damages and or faults must be reported on the day of delivery and noted on the delivery sheet. All other damages and/or faults must be reported within three working days of delivery. Any damages and/or faults reported after three working days will be treated as a warranty claim and corrected by the appropriate service company appointed to carryout such work. Guarantee. All appliances we sell are brand new boxed items usually supplied direct from the manufacturer. All appliances have a full manufacturers warranty which is 1 year unless otherwise stated. This does not affect your statutory rights as a consumer. Refunds. Refunds will be made within 30 days of notification, to the same credit or debit card that was used for the transaction. Cancellations and Returns. Please ensure that you are ordering precisely what you require to avoid any unnecessary expense later. We reserve the right to cancel orders at our discretion for any reason. You have the right to cancel your order within 7 days following the day you received delivery. However the goods must be returned in their original packaging and condition for a full refund within 30 days of return to the companys warehouse. You must also pay the cost of returning the goods and this is non-refundable. If you are unable to return the goods yourselves, we can arrange for this to be done on your behalf, but we will charge you for this service. Where you wish to return an item that is not an error on our part, and the goods have been ordered in specially, we will ask the manufacturer to accept it back. This will incur a re-stocking charge which may be as high as 25% of the value of the goods. All cancellations which are not as a result of unavailability will incur a minimum 2% admin charge. Unfortunately goods that have been connected for use and/or used can not be accepted for credit. You must notify us by email or phone during this period of your intention to cancel: info@ukappliancedirect.co.uk or 0870 300 8885. Payment. When you place your order we take full payment for the goods. You can pay for your order by Visa, MasterCard, Delta/Connect, or Switch. We will take all reasonable care to keep your order details and payment secure. All prices quoted on our Web Site include VAT. Orders can also be placed over the phone (Monday-Thursday 9am 4:30pm, Friday 9am 3:30pm) and will be processed in the same way we process online orders. For more accurate information on delivery times please phone or email with the product details and delivery areas and a customer service representative will respond to your enquiry. Delivery times can only be estimated. Credit card security. For your protection, delivery should be to the address to where the credit card is billed. If there is a genuine reason for delivering to a different address please advise us in writing. We will need to see proof of your connection to the delivery address, e.g. If you are moving house, then we can deliver to your new address. It is important that you inform your credit card company that you are ordering goods to a different address than the invoice address Disclaimer. UK Appliance Direct cannot be held responsible for any injuries or resulting financial loss from accidents, errors or omissions related to the order, we disclaim any loss of time and monies resulting from delays, non-deliveries, and wrong delivery. Complaints. We take complaints very seriously. We will acknowledge the complaint within 5 working days and provide a likely timescale for resolving the dispute, always keeping you informed about progress. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you for 2 reasons. Firstly, to process your order and secondly, to provide you with the best possible service. We will not e-mail you in the future unless you have given us your consent. The type of information we will collect about you includes: Your name Address Phone number Email address Credit/Debit Card details Information pertaining to the delivery of your appliances We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. The personal information which we hold will be held securely in accordance with our internal security policy and the law. |
